newsletter mailing

One of my customers has very industry specific products. He has purchased a list of specific customers, their phone and addresses as well as their email addresses from a company where the persons checked a box and agreed to recieve email from "partners."

He wants to send out a monthly newsletter following all rules from CAN-SPAM including easy opt out and detailed company information using this information.

However, as far as I can tell this would violate Westhost TOS as while they agreed to receive emails from partners they didn't specifically sign up for this newsletter...

What options does he have? Can this information be used ethically?

I would contact West Host and ask them about this. It may be that since it is a newsletter and if you follow Can-Spam rules that you would be allowed to do it. If they say no then your clients other option would be to use a service that sends the newsletter for them. This may be the better solution in the long run anyway since large mailings are not always handled well by some West Host account types.
